Distance sales agreement between Team Web Srl (www.bestdigit.it), with registered office in Via Santovetti, 60 - 00046 - Grottaferrata - (RM), hereinafter Team Web, and the customer:
RESPONSIBILITY'
Team Web Srl assumes no responsibility for disruptions attributable to force majeure that prevent, in whole or in part, the execution of the sales agreement within the agreed time. Team Web Srl will not be liable to any party for damages, losses and costs incurred as a result of failure to execute the sales agreement for the reasons mentioned above. The customer is only entitled to a possible refund of the price paid, excluding any shipping costs.
BUYER'S OBLIGATIONS
The buyer is strictly prohibited from entering false and/or invented and/or imaginary data in the registration procedure; the personal data and e-mail must be exclusively the buyer's real personal data and not those of third parties. The contract is concluded pursuant to and for the purposes set out in art. 1326 of the civil code, when "Team Web Srl" communicates online to the respective e-mail addresses of the Customers the validation of their order after checking the availability of the product. If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), once the online purchase procedure has been completed, he/she is obliged to print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance selling.
Product information
The photographs presenting the products are not part of the contractual scope and cannot in any case be considered as the responsibility of "Team Web Srl". The technical sheets and product descriptions are provided by the partners and/or suppliers of "Team Web Srl", which declines any responsibility regarding their content.
Prices
The sales prices indicated on the Site are expressed in euros (€) and include VAT but do not include delivery costs. Delivery costs are always borne by the Customers and are invoiced at the end of the order as a supplement to the selected products.
Availability
Customer orders are fulfilled within the limits of the quantity of products available. In the event that the ordered product is not available, "Team Web Srl" undertakes to contact Customers by email within 7 working days from the date of the order to inform them of the time required for delivery of the ordered product. The availability indicated on the Site is indicative and does not represent in any case a contractual obligation. The offers are linked to the quantity and/or the end date of the offer, an offer is over when one of the two conditions has ended (for example, a product on offer until the 31st of the month but with a red light is to be considered finished as the quantities have run out, if on the same object there is an arrival date after the end of the promotion, the same must be considered upon arrival with a NON-promotional price)
Right of withdrawal. Satisfied or refunded
"Team Web Srl" complies with the rules on the right of withdrawal contained in articles 64/67 of Legislative Decree no. 206/2005 (consumer code). The "consumer" has the right to withdraw from the contract stipulated, without any penalty and without specifying the reason, within 14 days from the day of receipt for goods, and from the day of conclusion of the "online" contract for services. This right can only be exercised by consumers, so all purchases made for purposes not unrelated to entrepreneurial or professional activity, i.e. where a VAT number is entered in the appropriate order form, do not enjoy this right. The consumer may exercise the right of withdrawal by making a specific complaint or by sending the relevant communication via email to assistenza-clienti@bestdigit.it or a registered letter with return receipt (to Team Web srl via Antonio Santovetti 60, 00046 Grottaferrata (RM)) . All costs for returning the products are expressly borne by the consumer, who, through his own forwarding agent, will forward the same to the logistics facility of "Team Web Srl" after the essential return authorization that will be communicated to the customer by "Team Web Srl" via email. Please note that the risks of transport for the return of the items are entirely borne by the consumer. All items must arrive in the same conditions as received, unused and completely intact, with the original packaging and any manuals, without any missing parts. The consumer cannot exercise this right of withdrawal for purchase contracts of audiovisual products, supplementary warranty contracts or sealed computer software, which have been opened by the consumer. With regard to the right of withdrawal applicable to mobile telephone products, it can only be exercised in the event that the use of the device in transmission or reception does not exceed 15 minutes in total ("life timer"). "Team Web Srl" will accept returned goods only after having verified that the products have been returned in their original condition and with intact packaging. Only in this case will it forward the amount paid by the consumer within the legal deadlines (14 days). "Team Web Srl" will credit the amount, including shipping costs, canceling the transaction (paypal - credit card) and/or by bank transfer. The Customer must provide his/her bank details (ABI Code - CAB - Current Account of the invoice holder) to receive the refund. In the event of forfeiture of this right, "Team Web Srl" will return the purchased goods to the sender, charging the latter with shipping costs.
Guarantees
All products sold on our site are covered by the legal guarantee of conformity of the manufacturer according to the terms of the law. Attention: the guarantee does not apply to repairs of damage caused by a cause external to the product (for example: accidents, impacts, lightning, power surges, etc.) or by a customer error (such as, for example, the use of an installation not compliant with the manufacturer's specifications, a use of the product that is harmful to it, a use of the product for commercial or collective purposes, the use of peripherals and/or accessories and/or unsuitable consumer products).
Disputes and responsibilities
The sales contract between the Customer and "Team Web Srl" is deemed to be concluded in Italy and regulated by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his/her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Rome.
